In a strong reaffirmation of how discipline and collective unity lie at the core of military functioning, the Supreme Court on Monday rejected the petition filed by Lieutenant Samuel Kamalesan, a Christian officer who sought to challenge his termination after refusing to take part fully in a regimental religious parade.

The bench, led by Chief Justice of India Surya Kant and Justice Joymalya Bagchi, upheld the earlier Delhi High Court judgment and made it clear that personal religious rigidity cannot override the collective discipline expected from every soldier in the Indian Army.

Senior Advocate Gopal Sankaranarayanan, appearing for Kamalesan, argued that the officer’s punishment was excessive and based on a single incident. He told the court that Kamalesan had only refused to enter the sanctum sanctorum of a temple during the parade because his monotheistic Christian beliefs did not permit him to step inside the inner chamber. The counsel stressed that aside from this, the officer had cooperated in multi-faith settings and had not resisted general participation.

The bench, however, took a stern view. Chief Justice Surya Kant openly questioned the officer’s behaviour, stating, “Is this kind of cantankerous behaviour permissible in a disciplined force?” He warned that such conduct amounted to “gross indiscipline” and remarked that the officer could have been dismissed for this act alone. The Chief Justice added sharply, “What kind of message he has been sending…he should have been thrown out for this only…grossest kind of indiscipline by an army official.”

Justice Bagchi highlighted an important point: a local Christian pastor had confirmed that merely entering a place of worship belonging to another religion does not violate Christian faith. Citing this, he explained that Article 25 of the Constitution protects only essential religious practices, not individual interpretations that conflict with lawful military duties.

Kamalesan’s counsel argued that the Army had forced him to perform Hindu rituals, which would go against his religion. But the bench clarified that no rituals were required from him at all — his role was simply to be present and lead the troop as part of the parade. Responding firmly, Chief Justice Kant said, “Leaders have to lead by example. You are insulting your troops.”

Background records showed that Kamalesan served in the 3rd Cavalry Regiment, which includes Sikh, Jat, and Rajput squadrons. Despite repeated counselling by superior officers, he continued to place his personal religious interpretation above lawful instructions, something the Army argued had a negative effect on troop morale and cohesion.

Rejecting even the request for a lesser punishment, the Supreme Court sent a clear message: in the Indian Army, secularism is not about avoiding others’ faiths but about respectful participation that strengthens collective unity. Concluding the hearing, Chief Justice Kant noted, “This will send a strong message.”
