In response to the growing unrest and increasingly hostile nature of the ongoing protests led by the Cockroach Janta Party (CJP), the central government has taken a decisive step to maintain law and order in the national capital. The central leadership has formally delegated broad preventive detention powers under the stringent National Security Act (NSA) directly to the newly appointed Delhi Commissioner of Police, Anurag Kumar.

The announcement was formally published in The Delhi Gazette (Extraordinary) on July 22 (Wednesday), as initially reported by The Tribune. However, official administrative records indicate that the notification itself was drafted earlier, carrying the date of July 15. This regulatory shift comes shortly after Anurag Kumar officially took charge as the head of the Delhi Police force.

Under normal legal provisions, statutory law under the NSA permits the state to detain individuals without formal criminal charges for periods ranging anywhere from 12 days to a full 12 months. According to the latest executive order, these special preventive detention powers are sanctioned to be active for three months, covering the period from July 19 through October 18. The official release explained that the Lieutenant Governor of the National Capital Territory (NCT) of Delhi felt fully convinced that granting such administrative powers to the top police chief was essential to safeguard public security.

Elaborating on the exact legal delegation, the statutory order cited the underlying legislative provisions:

“Exercising powers under Section 3(3) read with Section 2(e) of the NSA, the Delhi L-G has directed that during the specified period, the Commissioner of Police, Delhi, may also exercise the powers of a detaining authority under Section 3(2) of the Act.”

The legal mandate of the National Security Act specifies that such a delegation grants the Commissioner of Police the legal authorization to issue preventive detention orders against any persons whose activities are assessed to be detrimental to public order, national security, or the uninterrupted maintenance of essential supplies and services. Across various jurisdictions, designated authorities have the power to appoint District Magistrates and regional police heads as detaining authorities whenever necessary to protect public order.

A similar application of this law occurred last year in Ladakh. On September 26, the District Magistrate of Leh issued a directive invoking the provisions of the NSA to detain climate activist Sonam Wangchuk following the breakout of deadly violence during his public strike. Following that administrative order, Wangchuk was held behind bars for a total of 170 days.

In the current situation, the street demonstrations centered at Jantar Mantar—which originally began under the banner of student welfare to protest the NEET examination paper leaks and demand the resignation of Union Education Minister Dharmendra Pradhan—have rapidly escalated into severe violence. Protesters on the ground have resorted to attacking police personnel directly with stones and glass bottles. During the opening day of the monsoon session of Parliament, members of the CJP attempted to tear down security barricades to march toward the Parliament building, precipitating intense clashes and widespread disturbance in the capital.

Addressing the escalating standoff, senior government representatives clarified that the central administration has neither tried to hide mistakes nor minimize its responsibilities, but made it clear that it will not bow down to political demands. Emphasizing this position, one senior official remarked:

“There was a problem. We have said this on record and have taken responsibility on record. The government is not running away from it.”

Elaborating on the government's perspective regarding democratic dissent versus political maneuvers, another official weighed in on the nature of the agitation:

“We are not saying people should not protest. In a democracy, people have every right to protest. But who is raising the issue, how it is being raised and who is behind it are different questions. Should we succumb to political pressure,” the official questioned.

“The system was compromised by people we trusted. We are not the paper mafia. People within the system let us down; we trusted them. We did not hide the leak. We accepted responsibility and tried to fix it,” he added.
